TERMS OF USE: DISCLAIMER, WAIVER, AND RELEASE

The “Program” means the personal development program that Bethany Webster provides, including the Inner Mother Course.
I expressly acknowledge that Bethany Webster is a coach who believes in the benefits of therapy. I further expressly acknowledge and agree that Bethany is not a licensed mental health counselor and that she is not, and will not be, responsible for assessing, diagnosing, or treating any aspect of my health (including behavioral, mental, emotional, and physical) and that she has no duty to recommend that I seek services. If Bethany recommends services, it will be up to me whether to seek them. If I do decide to seek services, I will seek them from a professional who is licensed by the Massachusetts Board of Allied Mental Health and Human Service Professions, or its equivalent in my home jurisdiction.
My participation in or other use of the Program does not and will not establish a counselor-patient relationship, or similar relationship, with Bethany Webster.
Disclaimer
I agree that Bethany Webster unequivocally and comprehensively disclaims offering any medical or mental/behavioral health advice; that the Program does not constitute or contain medical advice or mental/behavioral health advice, nor does it serve as a substitute for such advice; and that only a licensed professional should assess, diagnose, and treat medical, mental, and behavioral health conditions. Solely as a courtesy and convenience the Resources section on Bethany’s site contains links to sites with information that Bethany believes might prove helpful to some Program participants and other site users. I agree that in offering these links Bethany is not providing advice and that she is not responsible for their content. Bethany does not warrant (expressly or impliedly) the information’s accuracy, reliability, completeness, merchantability, or fitness for a particular purpose.
Release and Waiver
I agree that Bethany Webster shall not be liable to me or anyone else for any decision I make or action I take in reliance on information Bethany provides via the Program or otherwise, or for any consequential, special or similar damages, even if advised of the possibility of such damages.
I, on behalf of myself and anyone claiming through me (including successors, heirs, personal representatives, and assigns) hereby knowingly, voluntarily, and irrevocably waive, and unconditionally release, acquit, and forever discharge Bethany Webster, her successors and assigns, as well as her past and present employees, venturers, partners, attorneys, and anyone claiming through them (collectively referred to as the Releasees), in their individual and corporate capacities, from any and all claims, liabilities, promises, actions, damages, and the like, known or unknown, which I ever had, now have, or may arise in the future against any of the Releasees arising out of or relating to my use of the Program, Bethany Webster’s site, and sites to which it provides links. Said claims include, but are not limited to, claims based on breach of contract, and on any tort, including but not limited to invasion of privacy, defamation, fraud, negligence, and the infliction of emotional distress, both intentional and negligent.
Without limiting the generality of the foregoing:
Access and Non-access
I agree that I indemnify and will hold Bethany Webster harmless from all claims arising out of or related to my access or use of, or my inability to access or use, the Program, Bethany’s site or the sites to which it provides links.
No Harm to Others
I represent, warrant, and agree that no content that I provide in connection with my participation or other use of the Program will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, and that it will not breach or conflict with any obligation of mine, such as a confidentiality obligation, or contain defamatory or otherwise unlawful material. I further agree that I will not disparage or cause harm to any other Program user or participant or to their property (both tangible and intangible), and that I indemnify and will hold Bethany Webster harmless from any claims by third parties that arise in connection with my alleged breach of this provision.
Copyright and Trademark
The copyright in the Program and the contents of Bethany Webster’s site belong to Bethany Webster and that Bethany Wester owns the trademark “Inner Mother Course.” I agree that I will not infringe the copyright or trademark rights of Bethany Webster and if I breach this provision I will be liable to Bethany Webster for statutory and other damages and reasonable attorney’s fees.
No License
My participation in the Program is exclusively personal. I acknowledge and agree that Bethany Webster is not granting me a license to (and does not permit me to) copy or otherwise use her Program or any aspect thereof as a coach, teacher, or instructor, whether commercially or as a volunteer.
